PAYMENT TERMS:
A non-refundable deposit equivalent to fifty percent (50%) of the total combined cost of the video/photo package, (includes.. selected add-on items and applicable additional charges) is required to be paid at the time this agreement is made between Illusion Media and the client. The remaining 50% balance is due no later than seventy two (72) hours prior to the event. Payments may be made in the form of Cash, Personal Cheque or Bank Transfer/Deposit.
REFUNDS:
•The client may be entitled to a full refund for the following reasons:
o Illusion Media does not capture the events on film due to gross negligence, absence or operator error.
o Illusion Media is unable to produce the final event video or raw footage due to damage/loss of equipment as a result of gross negligence, absence or operator error.
o Illusion Media terminates the relationship with the client, for any reason, prior to the event date.
•The client may be entitled to a partial refund for the following reasons:
o Illusion Media does not capture the events on film due to delay/failure of program as
a result of an act of God, natural disaster, equipment failure, strikes, transportation failure, fire or failure of others to deliver services, equipment, materials, death in the family, theft or any other act beyond Illusion Media's control.
o Illusion Media is unable to produce the final event video or raw footage due to damage/loss of equipment as a result of an act of God, natural disaster, equipment failure, strikes, transportation failure, fire or failure of others to deliver services, equipment, materials, death in the family, theft or any other act beyond Illusion Media's control.
•The client is not entitled to a refund of deposit, full or partial, for any of the following reasons:
o The client cancels this contract with Illusion Media for any reason.
o The client is unsatisfied with the finished event video.
o The client changes date/time of the event and/or venue to a date/time that Illusion Media is unavailable.
SHORT NOTICE BOOKING:
In the event that the client contacts Illusion Media for video/photo services within seven (7) days from the date of the event, a one-time fee of £45 will be added to the total cost.
TRAVEL:
Illusion Media will not charge the client a per-mile fee for any venue located within London area. Any venues located outside of London
will incur a £0.75 per-mile round trip charge.
REHEARSAL:
The client understands that Illusion Media will attend the rehearsal in order to allow the videographers to pre-visualize the event.
The client also understands that Illusion Media does not charge any fees to be present at the rehearsal.
Because Illusion Media's presence at the rehearsal is a voluntary and supplemental service, the client understands that failure
to appear at the rehearsal does not constitute a breach of these terms and conditions.
EQUAL SUBSTITUTION:
Illusion Media reserves the right to make substitutions to video/photo production equipment (video/photo cameras, audio recording devices, etc) to
that of comparable quality in the event that the advertised video/photo production equipment is unavailable due to damage, loss, theft, or any other
condition that prevents its use. Illusion Media also reserves the right to make substitutions or sub-contracts for videographers/photographers labour in
the event that either Tahir and/or Naz are unavailable for the event day. The client understands and agrees that any equipment
or labour substitutions made by Illusion Media do not constitute a breach or cancellation of this agreement.
DAMAGE TO EQUIPMENT:
The client agrees to accept full responsibility for the repair or replacement cost(s) of any of Illusion Media's equipment that sustains
damage as a direct or indirect result of the actions of any guest in attendance during the associated events, invited or not.
The client agrees to pay for the replacement cost(s) of any of Illusion Media's equipment in the event that the repair costs are
greater than the replacement cost.
LOW LIGHT FILMING:
The client understands that Illusion Media does not provide any form of artificial light for filming, but instead uses extremely light
sensitive cameras to capture the best footage using the existing lighting conditions. The client understands that if there is insufficient natural or
artificial light the image quality of the video will be greatly reduced. Illusion Media is not responsible for any unusable or poor-quality
footage due to insufficient lighting.
AMBIENT AUDIO:
Illusion Media is not responsible for any poor-quality or unusable audio due to interference from wind, animals, traffic, bodies of water,
fountains or other background audio elements present. Additionally, Illusion Media is not responsible for poor-quality or unusable audio due to
Un-amplified events.
NON-CONTRACTED VIDEOGRAPHERS AND PHOTOGRAPHERS:
The client agrees to take any necessary proactive or reactive measures to ensure that any non-contracted photographers or videographers will
not impede or interfere with Illusion Media's videographers filming. The client understands that Illusion Media's videographers
will make all reasonable efforts to work with or around any non-contracted photographers or videographers. The client also understands that
Illusion Media is not responsible for any footage that is lessened in quality or rendered unusable due to the interference or impedance
of non-contracted photographers or videographers.
CREATIVE AND ARTISTIC FREEDOM:
The client agrees to give Illusion Media full creative and artistic freedom for all on-location filming, post-production digital video editing, and final DVD production. The client is responsible for notifying Illusion Media of any special requests before any on-location filming or post-production digital video editing. Illusion Media will give the client an opportunity to view the edited video in a "final draft" form. It is the client's responsibility to make any editing requests during this time (3 days of receiving the final draft). If no requests are made, or if the client fails to screen the final draft of the edited video, the client agrees to accept the final video as-is, and revokes any rights to request changes to be made to the final video by Illusion Media.
MEALS:
The client agrees that Illusion Media is not responsible for any footage that is not captured while the videographers/photographers are obtaining or eating their meals.
COPYRIGHT:
Most films, videotapes, television programs, musical and audio recordings and many other materials are copyrighted. Unauthorized use of recordings or other copyrighted material is contrary to the provision of the copyright law. The client is solely responsible for obtaining copyright permission and any other necessary licensing of property used in this video production by Illusion Media.
OWNERSHIP:
Illusion Media retains full copyright and ownership of all footage captured by its videographers. Illusion Media will provide the client a copy of the raw footage at a charge per the client's request. Upon delivery of the copy, Illusion Media releases ownership rights of the copy to the client.
RELEASE FOR USE:
The client understands that Illusion Media may use any footage captured by its videographers for demo DVDs, portfolio work,
promotional clips broadcast online, or any other promotional use.
OVERTIME:
Unless otherwise indicated, Illusion Media will automatically charge the client for an additional hour of on-site filming time once
the purchased amount expires. The client understands that if additional time is not purchased Illusion Media will immediately cease
filming.
